Calif. Comp Rating Bureau Seeks 16% Hike
WCIRB logoSAN FRANCISCO - The Workers' Compensation Insurance Rating Bureau of California on Wednesday recommended a 16.0% pure premium rate increase that would be effective Jan. 1 if approved.

The WCIRB said it would recommend an additional 3.7% rate increase for January should California adopt a current proposal by the Division of Workers' Compensation change the state's disability rating schedule.

Double-Digit Rise in Health Plan Costs Projected
wcEmployers' health care costs are expected to increase by more than 10% in 2009, according to research from Aon Consulting Worldwide.

The survey of more than 70 leading health care insurers, representing more than 100 million insured individuals, forecasts an average 10.6% increase in health care costs for the 12-month periods beginning this year between April and September.

Court Upholds Ruling In Favor Of Bipolar Employee

OTTAWA - The Ontario Superior Court of Justice's Ottawa Divisional Court has upheld an $80,000 judgment in favor of an information technology specialist dismissed from his job just days after disclosing to his employer that he suffered from bipolar disorder.

Information technology specialist Paul Lane was fired from his position at ADGA Group Consultants Inc. in October 2001, four days after informing his manager he had Bipolar 1 Disorder and asking the manager to speak with him or contact his wife if she ever noticed any symptoms of a manic or depressive phase.  According to the divisional court's judgment he had been with the company a total of 10 days.

State High Court Rules On Permanent Disability Benefits

CHEYENNE, Wyo. - A coal miner is entitled to permanent total disability benefits under Wyoming's "odd lot doctrine," which considers the educational level of claimants limited to performing physical labor, the state's supreme court ruled.

Tuesday's decision in Robert Nagle Jr. vs. State of Wyoming overturns a state medical commission finding that was upheld by a district court and denied Mr. Nagle permanent total disability benefits for a 1987 foot injury and a related second injury in 2001 because he could not prove he was incapable of certain work.
