SACRAMENTO, Calif.—Insurers on Thursday filed suit against the California Department of Insurance in response to a department examination of disability policies that could lead to the withdrawal of all previously approved policy forms that it determines contain "unlawful" provisions. Insurers filing the suit in state Superior Court in Sacramento, Calif., said the department’s action could lead to rate hikes of up to 46% for group disability insurance and up to 33% for individual coverage.
SAN DIEGO—An employer is not liable for workers compensation benefits resulting from automobile accident injuries an employee suffered while sightseeing after concluding company business in Europe, a California appeals court ruled. Friday’s ruling in Fleetwood Enterprises Inc. vs. Workers Compensation Appeals Board stems from an Oct. 8, 1999, accident involving a design manager assigned to attend a trade show in Germany and visit a fiberglass supplier in Italy.
While Corporate America is recognizing the need to purchase proper liability insurance to protect directors' and officers' personal assets, many in-house corporate lawyers still have inadequate, if any, financial protection. Why are these individuals, whose role as close advisors to management and influencers of board decisions make them extremely susceptible to claims, left so vulnerable? Because insuring these individuals is often overlooked. "Standard D&O insurance policies typically protect non-officer employees only on a co-defendant basis," explains Mike Smith, President of the Professional Liability Division of National Union Fire Insurance Company of Pittsburgh, Pa. (National Union), a member company of American International Group, Inc. "These policies do not afford any protection to in-house counsel, even those who are corporate officers, in professional malpractice claims. In addition, most corporations do not mandate indemnification for in-house counsel as they do for directors and officers."
NEW YORK—Standard & Poor’s Corp. said Tuesday it is maintaining a negative outlook on the global reinsurance industry following this year’s series of hurricanes. "The outlook reflects near-term strains on reinsurers’ financial strength, after 2005 saw the largest catastrophe losses in the industry’s history," Laline Carvalho, a credit analyst at S&P in New York, said in a statement.
