AXIS CEO Sees
Insurers' Returns Eroding

HAMILTON, Bermuda (Reuters)-John
Charman, chief executive of Bermuda-based AXIS Capital,
says insurers are caught between softening policy rates
and volatile investment markets, a situation he expects
to hurt returns.
"You could make the case that
this is the perfect storm-where you have minimal prices
in the insurance industry, and at the same time
extraordinary volatility in your investment portfolio,"
Mr. Charman told Reuters in an interview from AXIS'
Bermuda headquarters.

Suicide Tied to Work Injury Ruled
Compensable

CARSON CITY,
Nev.-A suicide sufficiently connected to an industrial
injury is compensable under Nevada's workers
compensation system, the state's highest court has
ruled.
State law barring family members from
collecting workers comp benefits if a worker's death
resulted from a "willful intention to injure himself"
does not apply when a "sufficient chain of causation is
established," the Nevada Supreme Court ruled in Sharon
Vredenburg vs. Sedgwick CMA and Flamingo
Hilton-Laughlin.

Agency, under fire for apparently discounting the impact
of climate change, on Thursday said global warming poses
real risk to human health and the American way of
life.
Risks
include more heat-related deaths, more heart and lung
diseases due to increased ozone, and health problems
related to hurricanes, extreme precipitation and
wildfires, the agency said in a new
report.

| Comp Insurer Must Pay for Gastric Bypass Surgery

SALEM, Ore.-An obese worker's gastric bypass surgery
is compensable under Oregon's workers compensation law
because the procedure was necessary to treat a
job-related knee injury, an appeals court ruled
Wednesday.
The ruling in SAIF Corp. and Jerry's Specialized
Sales vs. Edward G. Sprague affirms a finding by the
state Workers' Compensation Board that SAIF Corp., a
state-chartered workers comp insurer, must pay for the
weight-loss surgery Edward Sprague underwent in
2001.
